1. Introduction
Welcome to Creativefy. By accessing or using our design, branding, and digital marketing services, you agree to comply with and be bound by the following Terms and Conditions (“Terms”). Please review these Terms carefully. If you do not agree with any part of these Terms, you should not use our services.

2. Services Provided
Creativefy provides comprehensive services, including but not limited to:
Website Design and Development: Custom and template-based websites tailored to Client specifications.
Branding Services: Logo creation, stationery design, brand guidelines, and brand strategy consultation.
Digital Marketing: SEO, social media management, content creation, and campaign management to enhance online presence.
Additional Services: Any other custom services outside the standard offerings may incur additional fees as agreed upon.

3. Project Initiation and Timeline
Projects begin upon:
Deposit Payment: A non-refundable 50% deposit is required before work begins.
Submission of Client Information: Clients must provide all necessary information, including brand assets, content, and project requirements.
Timeline Adherence: Creativefy commits to project timelines; however, delays in receiving Client feedback or required materials may impact delivery dates.

4. Payment Terms
Deposit and Balance Payment: A 50% non-refundable deposit is due at the start of the project. The balance is due upon project completion or as outlined in the proposal.
Additional Charges: Additional fees apply for services beyond the original project scope, such as extra revisions or new functionalities.
Late Payment Fees: Payments not received by the agreed date may incur additional fees or service suspension until resolved.

5. Copyright and Ownership
Intellectual Property Rights: All designs created by Creativefy remain the intellectual property of Creativefy until full payment is received.
Logo Designs: Upon full payment, Clients receive source files for logos, while Creativefy retains the original copyright.
Other Designs: Clients are provided with a JPEG or PDF for approval. Source files for additional design assets may be purchased for an agreed-upon fee. Creativefy retains the original copyright for all designs created.
Usage Rights: Upon payment completion, Clients have the right to use the final designs for their intended purposes. Designs cannot be altered, edited, or redistributed without prior written consent from Creativefy.
Transfer of Copyright: Should Clients purchase source files, they obtain the right to use, reproduce, and modify the design. Reselling or distributing source files or designs without written consent from Creativefy is prohibited.

6. Client Responsibilities
Timely Submission of Content and Assets: Clients must provide all necessary information, images, and content on time to avoid project delays.
Feedback and Revisions: Creativefy allows up to three rounds of revisions per project deliverable. Additional revisions may incur extra fees.
Legal Compliance: Clients are responsible for ensuring all submitted content complies with copyright laws.

7. Confidentiality and Privacy
Creativefy treats all Client information as confidential and will not disclose proprietary information to third parties without prior consent, except as required by law. We comply with all applicable data privacy regulations to protect Client information.

8. Limitation of Liability
Creativefy is not liable for any direct, indirect, incidental, special, or consequential damages, including lost profits, revenue, data, or use, arising from your access to or use of our services. Clients agree to use Creativefy’s services at their own risk.

9. Indemnification
Clients agree to indemnify and hold Creativefy harmless from any claims, damages, losses, or legal fees resulting from content, designs, or other materials provided by the Client or from the Client’s use of our services.

10. Termination of Services
By Creativefy: Creativefy reserves the right to terminate services if the Client breaches these Terms or engages in conduct detrimental to our business or reputation.
By Client: Clients may terminate the agreement by providing written notice. In such cases, deposits are non-refundable, and Clients may be charged for any completed work.

11. Refund Policy
Non-Refundable Deposit: The initial deposit is non-refundable once work has commenced.
Service Cancellation: Refunds may be considered if Creativefy is unable to deliver the agreed-upon services due to unforeseen circumstances.
Partial Refunds: Prorated refunds may be issued at Creativefy’s discretion for partial work completed.

12. Dispute Resolution
All disputes will first be subject to mediation in Clark County, Nevada, prior to any legal action.

13. Governing Law
These Terms are governed by and construed in accordance with the laws of the state of Nevada. Legal proceedings will be conducted in Clark County, Nevada.

14. Force Majeure
Creativefy is not liable for delays or non-performance resulting from causes beyond reasonable control, including natural disasters, government actions, or power outages.

15. Changes to Terms and Conditions
Creativefy reserves the right to amend these Terms at any time without prior notice. Continued use of our services constitutes your acceptance of the new Terms. Clients are encouraged to review the Terms periodically.

16. Agreement
By engaging Creativefy’s services, Clients acknowledge and agree to the Terms outlined in this document. All copyright rules apply to any and all transactions without requiring a separate agreement.
17. Holiday Scheduling
Creativefy observes select holidays during which services are unavailable. If your scheduled service date falls on one of these holidays, our team will contact you in advance to coordinate a convenient rescheduling option.

Memorial Day
Independence Day
Labor Day
Thanksgiving Day
Christmas Day

1. Web Design Services
Creativefy provides professional web design services that are customized to reflect your brand and meet your business objectives. Our design package includes:
Full Website Design and Development
Initial Setup on Our Hosting Platform
We strive to make your online presence as impactful and effective as possible.

2. Hosting and Management Services
Once your website is complete, Creativefy offers ongoing management and hosting services for a monthly fee. This service includes regular updates, maintenance, and support to keep your website live and fully operational. With us handling the technical details, you can focus on what matters most — your business.

3. Self-Management Option
For clients who prefer to manage their website independently, Creativefy offers a Self-Management Option for a one-time fee of $1,000. This option grants you full control over hosting, updates, and maintenance once we transfer all necessary files and access.
Conditions for Self-Management:
Upon receipt of the $1,000 Self-Management fee, Creativefy will transfer all website files and access.
Clients assume full responsibility for setting up and managing hosting and all technical aspects of the site.
Once the transfer is complete, Creativefy’s support, maintenance, and management services will conclude.

4. Payment Terms
Web Design Fees: Full payment is required before design work begins.
Self-Management Fee: The $1,000 fee must be paid in full before website transfer.

5. Refund Policy
Due to the customized nature of our services, payments for web design and management services are non-refundable once work begins. The Self-Management Option fee is non-refundable once the website has been transferred to the client.

6. Termination of Services
Should you choose to discontinue Creativefy’s monthly management services, written notice is required. Upon termination:
Clients may opt for the Self-Management Option, taking full control of the website.
Without the Self-Management Option, hosting and management will be discontinued, and the website will go offline.

Please Note: There is a 30-day cancellation policy. If monthly management services are canceled, an additional billing cycle will apply before the service is terminated.

7. Policy Changes
Creativefy reserves the right to modify or update this Web Design Policy at any time. Updates will be reflected in this document and communicated as necessary to ensure transparency.

1. Copyright Ownership
All graphic designs created by Creativefy LLC are the intellectual property of Creativefy LLC. This includes, but is not limited to, logos, car wraps, flyers, banners, business cards, and any other graphic materials produced by our talented team.

2. Logo Designs
Upon full payment of the design fee for a logo, Creativefy LLC will provide you with the source files (copyright files).
You will have the right to use the logo for any personal or commercial purposes.
Despite the transfer of source files, Creativefy LLC retains original copyright rights to the design, ensuring its integrity and ownership.

3. Other Graphic Designs
For all other graphic designs (e.g., car wraps, flyers, banners, business cards), Creativefy LLC retains ownership of the source files.
You will receive a JPG of the artwork during the approval process.
Should you wish to obtain the source files, they may be purchased for a fee equal to five times the original design fee.
Creativefy LLC maintains original copyright rights to all designs created, even if you purchase the source files.

4. Usage Rights
Upon full payment of design fees, you are granted the right to use the final designs for their intended purpose. Note that this is based on the understanding that printing services will be provided by Creativefy LLC. If you choose to use the designs with another print shop, the source files must be purchased separately.
Designs cannot be altered, edited, or modified without prior written consent from Creativefy LLC.
Any reproduction or redistribution of the designs beyond the agreed scope requires explicit permission from Creativefy LLC.

5. Transfer of Copyright
If you purchase the source files for any design, you obtain the right to use, reproduce, and modify the design.
Creativefy LLC retains original copyright rights to the design even after the purchase of the source files.
You are prohibited from reselling or distributing the source files or designs without prior written consent from Creativefy LLC.

6. Enforcement and Violations
Any unauthorized use, reproduction, or distribution of Creativefy LLC designs will be considered a violation of this copyright policy.
Creativefy LLC reserves the right to take legal action against any party that violates the terms of this policy.

7. Agreement
By engaging with Creativefy LLC for any graphic design services, you acknowledge and agree to the terms outlined in this copyright policy. All copyright rules apply to every transaction without requiring a signature.
